The sale of the Products is carried out under the trade name Victoria Clothes.
2. Definitions
The terms used in these general conditions or on the website www.gmfashion.be must be understood as follows:
- Site: website www.gmfashion.be on which the products are offered for sale to the Customer
 - GMFA: the Srl Guy Mylène Fashion Agency which offers its Victoria Clothes Products for sale on the Site
 - Customer: any person who places an order for product(s) on the Site
 - General Conditions of Sale: these general conditions of sale
 - Order: request made by the Customer on the Site with a view to concluding a sales contract relating to one or more Products offered for sale on the Site, between GMFA and the Customer
 - Product sheet: all information (texts, photos, graphics, classification system by category, etc.) linked to a Product offered for sale on the Site
 - Products: all goods offered for sale by GMFA under the name Victoria Clothes on the Site
 - Transaction: all operations, secure processing, authorizations and agreements inherent in the payment of products ordered by bank card or by any other means of virtual transaction offered on the Site.
 
3. Acceptance and application of the general conditions of sale
The Customer acknowledges having read these general terms and conditions of sale and declares, by placing the order, expressly accepting them without reservation. Validation of the order constitutes acceptance of the general terms and conditions of sale.
The specific conditions of each sale (items purchased, prices, terms, etc.) as well as these general conditions of sale constitute the entire contractual framework applicable to any sale that takes place on the Site. They cancel and replace any other possible prior communication (except for express written exception and jointly approved by the parties).
4. Registration / Access to the site
Access to the Site's homepage and its content is free without the prior creation of an account being required. Placing an order for Products on the Site can be done either by prior creation of an account on the Site, or as a guest, without the creation of an account being necessary.
Creating an account on the Site as a Client implies having previously read and accepted without reservation these Conditions.
The Terms and Conditions contain the terms and conditions of use of the Site and the sale of Products by Victoria Clothes. Before validating the creation of their account, the Customer will be asked to confirm that they have read and accepted them, unless they can provide proof to the contrary.
Victoria Clothes may, at any time, modify and adapt these Conditions in order to:
(a) to bring them into conformity with the legislative or regulatory provisions in force or in the process of being adopted to which it is subject;
(b) to bring them into conformity with any decision rendered by a judicial or arbitral tribunal, or issued by any other competent authority and whose decisions are binding on it;
(c) to correct any material error.
The applicable Conditions will be those in force at the time of use of the Site or conclusion of the Contract.
Without prejudice to applicable legislative and regulatory rules, Victoria Clothes will notify any modification and/or adaptation of the Conditions, or any other rule relating to the use of the Site by means of a message addressed to Customers via the Site.
The Customer who does not wish to agree to the modifications made remains free to request the deletion of his account on the Site by sending a request to this address to contact@gmfashion.be.
5. Customer Commitment
The Client declares to be legally capable, to be an adult or a minor with parental authorization.
The Customer undertakes to create and maintain only one account on the Site.
The Customer undertakes not to use the Site and/or his account on the Site fraudulently or for fraudulent purposes.
The Client undertakes to comply with applicable legislation and regulations.
The Customer undertakes to provide information, in accordance with these General Terms and Conditions, which is accurate, precise and up-to-date.
The Customer is the holder of the bank card with which payment for the Product(s) ordered on the Site will be made in accordance with these General Terms and Conditions or confirms that they have the proper authorization of the holder.
Customers will ensure the confidentiality of their username and password. They will constantly keep their account information up to date.
6. Availability of products
All orders for Products are subject to availability.
If the Products are no longer in stock after the Customer has placed the order, Victoria Clothes will inform the Customer as soon as possible and, in the event that a payment has already been made, Victoria Clothes reserves the right to initially make a refund in the form of a voucher usable on the website. Secondly, and upon clear written request from the Customer, Victoria Clothes will make the refund using the same means of payment as that used by the Customer for the initial transaction, unless expressly agreed otherwise. In any event, this refund will not incur any costs for the Customer.
7. Order process
The Customer connects to the Site, fills his shopping cart and places an Order for the products he has chosen by browsing the Site, in accordance with this article.
The Customer can then either log in to their account or log in as a guest to place the order.
The total amount of the order, including all taxes, plus delivery charges, is shown in an order summary and the Customer is then asked to confirm their willingness to pay for the order in accordance with the means available for this purpose. They must also accept the Terms and Conditions.
Once payment has been made, the Customer receives confirmation of their order by email with a copy of these Conditions.
The Customer undertakes to keep a copy of this confirmation email, as well as a copy of these General Terms and Conditions, either by printing them or by storing them on a durable medium.
Unless otherwise stated, Victoria Clothes only offers for sale on the Site Products that are available in stock or available within 24 hours
In the event of an order for a Product which, for whatever reason, requires a restocking period of more than 48 hours, Victoria Clothes will inform the Customer who will have the option to continue, modify or cancel their Order only with regard to the missing Product.
The Customer agrees to receive the invoice corresponding to the Order in electronic version.
8. Price / Payment
Prices are quoted in euros, including VAT but excluding any customs fees, which remain the responsibility of the Customer. In this regard, the Customer is required to inquire about the possible application of customs fees.
The prices are those indicated on the Site in the description sheet of each Product, except in the event of an obvious error.
If Victoria Clothes detects an error in the price of the Product(s) ordered, it will inform the Customer as soon as possible and offer to confirm the order at the correct price or cancel it. If Victoria Clothes is unable to obtain a response from the Customer regarding the alternative offered within eight calendar days, it will cancel the order and refund the amount paid.
Prices do not include delivery charges.
The payment methods offered on the Site are those implemented by the ShopifyPayments platform (Visa, MasterCard, Maestro, Bancontact and PayPal).
9. Delivery
After confirmation of the Order and acceptance of full payment of the price and delivery costs, the Products are prepared and shipped to the delivery address indicated during the order process according to the Customer's choice.
All details concerning deliveries (name of carrier, prices and delivery times) are available in the “Delivery” section of the Site.
The Customer understands that the delivery times mentioned when placing the Order or on the Site are provided for information purposes only, and that they may vary depending on circumstances. Under no circumstances does their mention constitute a commitment on the part of Victoria Clothes, which cannot be held liable in the event of longer delivery times, provided that the legal deadline is respected.
By placing an Order, the Customer agrees to pay all taxes, duties, levies and other charges, present and future, due in respect of the delivery of the Products ordered. Victoria Clothes cannot be held liable in this regard.
For delivery addresses outside Belgium, delivery times vary depending on the delivery method chosen. All approximate delivery times and methods are available in the "Delivery" section of the Website.
Victoria Clothes offers a single delivery method, at the rates applicable at the time the Contract is concluded. For home delivery, in the event of the Customer's absence, DPD will provide a delivery note indicating the nearest collection point to the Customer's home. Delivery methods and their respective rates are available in the "Delivery" section of the Website.
Victoria Clothes cannot be held responsible for errors made by the Customer in the delivery address, nor for any delays in delivery or the impossibility of delivering the products ordered that these errors may cause.
In the event of the Customer's absence or an error in the delivery address making delivery impossible, it is the Customer's responsibility to arrange a new delivery with the carrier. Any additional costs incurred will be borne by the Customer.
If a package is not received despite the carrier's multiple attempts, it will be returned to Victoria Clothes and the Customer will be notified by email. An additional delivery may be requested by the Customer, who will bear the costs (even if the first delivery was free of charge).
Without prejudice to the provisions relating to the availability of the Products, Victoria Clothes will make every effort to execute the order placed by the Customer within the time indicated in the "Delivery" section of the Site and, in any case, within a maximum period of thirty days from the date of order confirmation.
If Victoria Clothes is unable to meet the delivery date for any reason, it will inform the Customer as soon as possible and offer to either continue the execution of the Contract with a new delivery date or to terminate the Contract and refund the amounts paid by the Customer.
Upon receipt of the ordered Products, the Customer must check that the delivered product is in good condition. In the event that one or more of the ordered Products are missing or damaged, it is recommended that the Customer or the recipient make the necessary reservations to the carrier at the time of delivery and/or contact Victoria Clothes.
“Delivery” will be considered to have been made, or the order will be considered to have been “delivered”, at the time when the Customer or a third party designated by him is in physical possession of the Products, which will be evidenced by the signature of the acknowledgment of receipt of the order at the agreed delivery address.
10. Complaint
In the event of a visible and/or qualitative defect in an item or other defect noted by the Customer upon delivery, the Customer undertakes to contact Victoria Clothes as quickly as possible to report it. In such a case, the Customer undertakes to describe the defect he/she has noted as clearly and exhaustively as possible. It is recommended that these complaints be communicated in writing (contact page, email, mail) and accompanied by supporting documents.
11. Right of withdrawal
In accordance with the legislation in force for distance selling (law of December 21, 2013), the Customer has the right to cancel their purchase, without penalty and without giving any reason.
The Customer, or a third party other than the carrier and designated by the Customer, has a period of 14 calendar days from the day after the day of receipt of the Products to express their wish to withdraw.
To exercise his right of withdrawal, the Customer uses the withdrawal form available HERE or any other unambiguous declaration, expressing his wish to withdraw, to the address of Victoria Clothes using the Contact page of the site or by any other written means (e-mail, mail).
The Customer undertakes to return the Product without delay or at the latest within fourteen (14) days following notification of his/her wish to withdraw to Victoria Clothes. This deadline is deemed to have been met if the Customer has returned the Product before the expiry of the fourteen (14) day period.
The Customer is requested to return the Product(s) in their original packaging, intact, accompanied by all possible accessories (such as and among other instructions for use and documentation), in good condition and with a copy of the purchase invoice.
The Customer must bear the direct costs of returning the Product.
Victoria Clothes will refund all payments received from the Customer (except for additional delivery charges resulting from the Customer's choice) without undue delay and, in any event, after receipt and processing of the return. Victoria Clothes reserves the right to initially make the refund in the form of a voucher usable on the website. In a second step and upon clear written request from the Customer, Victoria Clothes will make the refund using the same means of payment as that used by the Customer for the initial transaction, unless expressly agreed otherwise. In any event, this refund will not incur any costs for the Customer.
Once your return request has been initiated, you will receive an email with the process to follow and the conditions to be met to make the return.
The Customer will not be entitled to any refund if the delivered Product has been used, if it is not in the same condition as at the time of delivery (in the original packaging, with the label string intact) or if it has been damaged. The Customer will nevertheless be entitled to a refund if the depreciation of the Products results from handling necessary to ensure the nature, quality and functioning of the latter.
The return of Products does not allow an exchange for one or more other Product(s). If necessary, the Customer must place a new order on the Site.
12. Warranty of consumer goods
In accordance with Articles 1649 bis to 1649 octies of the Civil Code, Victoria Clothes is liable for any lack of conformity which exists at the time of delivery of the Product and which appears within two years of this delivery.
It is agreed that the Customer must notify Victoria Clothes of any lack of conformity, in writing, within a maximum period of two months from the day on which it discovered the defect. Failure to comply with this obligation will result in the loss of the Customer's rights for lack of conformity.
The Site contains links to other websites. Victoria Clothes cannot be held responsible for the current or future content of these Sites, nor for the content of external sites that have a link to the Site.
13. Intellectual Property
All rights, titles and interests in the Site belong to Victoria Clothes. The graphic and visual elements (including logos and photos), product sheets, texts, codes and structure of the Site as well as all elements appearing on the Site belong entirely to Victoria Clothes (or to third parties having authorized Victoria Clothes to use them) and are protected by the principles of intellectual property law. They may not be copied, transmitted, reproduced, distributed or transformed under any circumstances without the express written consent of Victoria Clothes.
Any fraudulent use or manipulation of the Site, either through the use of third-party data, or through the use of software or any other process, intended to modify or collect data found on the Site or intended to make its use impossible, will automatically be the subject of a complaint to the competent authorities.
14. Personal data
The collection of personal information for the purposes of distance selling is mandatory, as this information is essential for processing orders. Failure to provide this information will result in the order not being validated.
Therefore, by placing the Order, the Customer gives his consent to the use, processing and storage of his personal data within the framework of the execution of the Order in accordance with the General Data Protection Regulation (2016/679).
The customer has the right to access, modify, rectify and delete data concerning him/her. To this end, he/she can send a request to Victoria Clothes.
The customer also has the option to view and modify their information at any time via the My Account page.
Victoria Clothes undertakes never to communicate the contact details or personal data of its customers to third parties.
Victoria Clothes is not responsible for Customers' management of their username and password, nor for the management of their account.
15. Modification of the Site or the general conditions of sale
Victoria Clothes reserves the right to make changes to its Website, procedures and T&Cs at any time.
The General Terms and Conditions in force at the time the Order is placed by the Customer will be the reference conditions, unless a change to these conditions is required by an administrative or governmental authority. In this case, these modifications may apply to orders prior to the modification.
16. Miscellaneous provisions
If any provision of the T&Cs is declared void, invalid, illegal or unenforceable for any reason whatsoever, the Customer and Victoria Clothes agree that the others will remain fully applicable. The void, invalid, illegal or unenforceable clause will be replaced retroactively by a valid and enforceable clause whose content is as close as possible to that of the original clause.
The Customer and Victoria Clothes agree that they may exchange information necessary for the execution of these General Terms and Conditions electronically. Any electronic communication between them has the same evidentiary value as a written document on paper.
Neither the Customer nor Victoria Clothes shall be held liable for any delay in the performance or non-performance of its obligations resulting from force majeure events (as defined by Belgian case law).
Any communication or notification that Victoria Clothes makes to the Customer will be deemed valid as soon as it is addressed to the email address that the Customer has provided, even if this is no longer valid.
The invalidity of any provision of these Terms will be limited to the invalid provision and will not affect the remainder of these Terms.
The use of the Site and any Agreement concluded through the Site are governed by Belgian law.
17. Applicable law and competent jurisdiction
Belgian law alone is applicable to Orders placed on the Site and to any dispute relating thereto.
In the event of difficulty or dispute, Victoria Clothes may initiate conciliation or mediation action, before any legal action, in order to seek an amicable solution, without however being obliged to do so.
If the dispute persists, the courts of the district of Liège shall have sole jurisdiction.
18. Protection of personal data
